Grade A Customary Court, Mapo, Ibadan, Oyo State, has put an end to the wedlock between a couple, Olamide Saheed and Lawal Saheed, on the grounds that the latter was irresponsible, regularly drank himself to stupour and assaulted his wife both physically and verbally for refusing him sex.
Olamide told the court that Lawal never saw it as his duty to provide for her needs and that of their children.
She stated that all that her husband spent his money on was alcohol.
Olamide explained that Lawal would come back home drunk and then demand for sex after starving her and their children all day.
The plaintiff told the court that she always got back on her husband by denying him sex and they would fight throughout the night.
According to the plaintiff, the defendant being destructive in nature would visit her shop and destroy her goods.
She stated that she moved out of his house when he almost ruined her business and killed her.
The plaintiff as a result appealed to the court to hear her prayer of divorce and also grant her custody of their children and mandate her husband to be responsible for their welfare.
She further prayed the court to restrain him from threatening and fighting her in her new place of abode and shop. Lawal acknowledged that he was a drunk, but prayed the court not to end their union.
Olamide in her evidence said: “My lord, only two things brought fulfillment to my husband throughout the time we lived together and these were alcohol and sex.
“My husband would drink himself to stupour and stagger home demanding for sex.
“I always refused him sex because he refused to be responsible. He neglected my wellbeing and that of our children and consistently starved us. As a result, I carried out a dual role in the home.
“My husband and I fought almost every night over sex. He would get angry and beat me to a pulp for denying him sex.
“Our neighbours always got weary of us and would complain that we were depriving them of a restful night sleep.
“Lawal rather than being remorse would fight them. As a result they were always at loggerhead with him and he had no friend among them.
“There were times he sent me out of the house into the cold late in the night after beating me.
“I moved out of his house after he almost snuffed life out of me by punching me, but he refused to let me be.
“My husband being a destructive person would come to my shop to embarrass and fight me and also destroy my goods.
“I got fed up one day and got him arrested by the police. He was made to write an undertaking not to disturb me again, but he went back to his old ways a few weeks after this.
“My husband now abuses me and rains curses on me on the phone.
“My lord, I beg this honourable court to dissolve our union and put our children in my custody.
“I again plead that the court enforces it that my husband be responsible for our children’s feeding and education.
“I also plead that the court stop him from coming to my house and shop to fight and destroy my goods, “the plaintiff stated.
Lawal in his testimony said, “I admit that I drank, but I have changed.
“I beg this honourable court not to dissolve our marriage, but plead with my wife to forgive me.

Ruling, the court president, Mrs S.M Akintayo, dissolved their union and granted the plaintiff custody of their children.
The defendant was ordered to be in charge of their upkeep, NIGERIAN TRIBUNE reports.
He was also restrained from threatening and fighting the plaintiff and destroying her goods.
