Justice Ibrahim Buba of the Federal High Court in Lagos has fixed hearing of a motion filed by the suspended Governor of the Central Bank of Nigeria, Sanusi Lamido Sanusi, for March 21.
Prompt News recalls that the court had on February 21 granted an interim order of injunction restraining the AGF, IG and DSS from arresting, detaining or harassing the suspended CBN governor pending the determination of the motion on notice.
He was also granted the leave to serve the originating summons and other accompanying court processes on the respondents.
Sanusi, who filed the suit through his counsel, Prof Yemi Osibanjo (SAN) is seeking to enforce his fundamental right.
The suspended CBN governor who also joined the Attorney General of the Federation in the suit as first respondent as well as the inspector general of Police and the Department of State Service (DSS) as second and third respondent.
Sanusi, is also seeking an order restraining the police and officers of the Department of State Security from arresting, detaining or otherwise harassing him.
Following an application for adjournment moved by counsel to the three respondents, Justice Buba, on Friday adjourned it to March 21 for hearing.
Dr. Oscar Nilam, who si holding brief of Mike Ozekhome (SAN) told the court that they were yet to receive all the processes filed by the applicant, and therefore prayed the court for a short adjournment to enable him collate all processes.
Counsel to the inspector General of police, Chukwu Agwu, and Counsel to DSS, Ahmed Musa, also prayed for adjournment.
The counsel representing the applicant, Kola Awodehin (SAN), counsel representing the applicant did not object to the prayers for adjournment.
However, he stressed that the suit bordered on fundamental rights enforcement of his client and thus opined it should be dealt with expeditiously.
