Magistrate Olusola Aluko of an Osogbo Magistrate Court was on Friday told how two suspected homosexuals allegedly engaged in indecent sexual practice inside the auditorium of a church in Osogbo.
The two middle-aged men were arrested at the Peace of Jesus Apostolic Church, Asubiaro, Osogbo, Osun state capital where the crime was said to have been committed.
The charge sheet read out in court by the prosecutor, Solomon Oladele reads in part: “That you, Samuel Friday, and Oni Oluwatobi at Peace of Jesus Apostolic Asubiaro Osogbo in Osogbo Magisterial District did conspire together to commit felony wit indecent sexual practice between yourselves.”
The offence committed by the two men, according to the police prosecutor runs contrary to and punishable under Section 516 of the Criminal Code Cap 34 Vol. II laws of Osun State of Nigeria, 2003.
Sequel to plea by the accused persons and an assurance given by their counsel, Nenna Ugwu, Magistrate Aluko granted them bail in the sum of N100, 000 with two sureties each in the like sum.
The case was subsequently adjourned till November 14, 2013 for mention.
