A Sharia Court ll sitting at Magajin Gari, Kaduna on Monday ordered one Muhammad Yusuf, a businessman to pay N5,000 for defaulting a court order.
The Judge, Malam Murtala Nasir said the action was in accordance with order 16 of the Sharia Civil procedure law.
Nasir had on Aug. 15, ordered Yusuf, a resident of Tudun Wada area of Kaduna to refund N193, 000 he owed his customer, one Hassan Dan-Borno on or before Sept. 15.
The News Agency of Nigeria (NAN) reports that the defendant was not in court and had not paid the money he was ordered to pay.
When the judge asked if he had been served, the court’s messenger said he was not served due to his absence at his residence.
The judge ordered Yusuf to be given substitute service along with Form 7 which is judge debt sermon.
NAN recalls that the defendant, had told the court that he received the sum of N243, 000 from the complainant for the purpose of buying a car for him.
“I couldn’t get the car for him, so, he asked for a refund of his money and I was able to pay N50, 000.
“I want this honourable court to intervene in the matter, so that I can pay him when I get the money,” Yusuf pleaded.
The judge adjourned the case till Sept. 30 for further hearing.
