More troubles seems to be coming the ways of the opposition party, All Progressive Congress (APC) and its standard bearer, General Muhammadu Buhari, as the National Coalition for Good Governance (NACOGG) and three others filed a suit to get him disqualified over the broiling certificate controversy.
In a matter with suit number FCT/HC/CV/935/2015 the four plaintiffs including Mallam Jamilu Aliyu, Chizoba Iwe, Hajia Zainab Mohammed and NACOGG dragged before the court the Attorney General of the Federation, the Inspector General of Police, the Director of State Security Service, INEC, APC and General Buhari.
Nine reliefs were sought by the plaintiffs before the Federal High Court. These are that:
It orders the immediate arrest, re-arrest and maintain a criminal process against Buhari for hacking and conspiring to hack into the INEC voters’ database;
A Declaration that General Buhari is not qualified to contest the 2015 Presidential General Election without the presentation of his minimum educational qualification;
A Declaration that the information in General Buhari’s affidavit submitted to INEC as to the custody of his certificate is false and does not permit him to contest the 2015 elections;
A Declaration that the result in circulation is forged and does not satisfy Constitutional requirements of law;
An Order to disqualify General Buhari from contesting the 2015 election for not presenting his minimum educational certificate;
An Order mandating INEC to disqualify General Buhari;
A Declaration that INEC should not allow, recognise or include General Buhari in the 2015 Presidential Election if he does not present the certificate;
An Order on INEC not to allow APC to present General Buhari for the 2015 election.
It would be recalled that a similar issue was also recently taken to another Abuja court which is also seeking for the former military Head of State to be banned from contesting the election.
The judge to handle the matter has not been named and date for the hearing is also yet to be known. However, the ongoing strike action by the judicial workers in the country may also be delaying the matter.
