The Court of Appeal Abuja has set aside the tribunal judgment which removed Governor Ademola Nurudeen Jackson Adeleke from office as the validly elected Governor of Osun State.
The three-man panel of Judges led by Mr. Justice Mohammed Shuaibu overruled the decision of the Osun State Governorship Election Tribunal which ruled that former Governor Adegboyega Oyetola was the validly elected governor instead.
But the Court of Appeal has unequivocally said the tribunal was wrong to reach the conclusion on over voting relying on oral witnesses as they considered the information that was in the Bimodal Voting Accreditation System (BVAS) machines and voters register.
The Court said the voters register is the foundation of any election and the voters register also central in this 2023 election.
“This appeal has merit and so we will allow it”, the court said.
