A Lagos State High Court sitting in Ikeja has ruled that the removal of Mudashiru Obasa as Speaker of the Lagos State House of Assembly was unlawful and unconstitutional.
Delivering judgment on Wednesday, Justice Yetunde Pinheiro nullified the Assembly’s January proceedings and resolutions that led to Obasa’s removal from office.
Obasa, through his legal counsel Chief Afolabi Fashanu, challenged the legality of the process, naming the Lagos State House of Assembly and Mojisola Meranda—who was appointed as the new Speaker—as defendants.
He argued that the decision was made while the Assembly was on recess and during his absence from the country.
He further contended that the session convened to remove him lacked legitimacy, as it was held without his consent or any formal delegation of authority, thereby violating the Assembly’s procedural rules.
The lawsuit, which rested on nine key points, drew on relevant sections of the amended 1999 Constitution and the Standing Orders governing the Lagos State House of Assembly.
